Three areas, two legal frameworks

A brochure compares areas by pools and distance from the sea. The difference that decides more is a different one: two of these are in Dubai and one is not, and that changes the register, the protection on your money, and who would hear a dispute.

The real split is not three ways

Dubai South and Dubai Maritime City are in the Emirate of Dubai. Al Marjan Island is in Ras Al Khaimah – a different emirate, with its own land register administered by the Lands & Properties Sector of Ras Al Khaimah Municipality, and its own rules.

All the legislation cited across most of this site – Dubai's real property registration law, the escrow accounts law, the interim register, Article 11 – is Dubai legislation. It does not apply in Ras Al Khaimah.

So the comparison that matters is not between three areas but between two legal frameworks, one of which holds two of these areas and the other one.13,1

There are no prices, yields or forecasts in the table, and not by accident: those are not figures that can be cited to a primary source, and this site does not publish a number without a source and a date. The differences that are not legal – distance, stage of development, character of the surroundings – are true of this moment and change; the best way to judge them is in person.

An area you can point at, against one you have to check

This is the most useful difference between the two Dubai areas here, and it is almost never mentioned anywhere.

Dubai has no single consolidated official list of the areas designated for foreign ownership. There is Regulation No. 3 of 2006, and there is a series of resolutions adding land over the years, each naming specific plots. So for most areas you cannot say "this area is freehold" – you can only check a particular plot.

Dubai South is a rare case where the instruments can be pointed at directly: Resolution 8/2016 of 9 June 2016 added three plots in Madinat Al Mataar – 205, 206 and 207 – and Resolution 7/2021 of 3 March 2021 added a further 21 on the same rights, and validated earlier dispositions by the Dubai Aviation City Corporation in those plots.

Maritime City falls under the ordinary rule. There is no single resolution to put on the table, so the check is always the specific project's plot number.4,5,2

And what about Dubailand?

A fair question, since Dubailand appears in the marketing of many projects – and has no area guide of its own here. The reason is specific, and it can be checked.

We looked for an official document defining Dubailand: a law establishing it, as Law 11/2015 establishes Dubai South and Law 11/2007 Maritime City, or an instrument designating plots within it for foreign ownership. We found neither.

What we did check, one by one: Regulation 3/2006, the founding instrument, names 23 areas, and Dubailand is not among them. The six resolutions adding land since then name plots elsewhere – Madinat Al Mataar (14/2015, 8/2016, 7/2021), Trade Centre Second and Zaabeel Second (14/2015, 18/2019), Jebel Ali Industrial Third, Ras Al Khor Industrial Third and Al Warsan First (25/2021), and Zabeel First (6/2022). Dubailand appears in none of them.

The conclusion is not that something is wrong with Dubailand. It is that Dubailand is a masterplan name rather than an administrative unit – the name spans several registered localities – and so it tells you nothing about ownership status. That is exactly the position described above for Maritime City, and it is the rule rather than the exception.2,6,4,7,5,8,9

What to check, by area

  1. In both Dubai areas: the plot number and its status

    Ask the developer for the plot number and confirm its status with the Land Department. The project status enquiry returns status and completion percentage by plot number, project number or name.17,16

  2. In both Dubai areas: the escrow account

    The Dubai REST app shows the project's escrow account number. Compare it with the number in the contract before the first transfer.12,18

  3. In Maritime City only, if you are buying to let

    Ask a local lawyer which forum would hear a tenancy dispute over your property and which rules on rent increases would apply, given the special status Article 12 gives the district. That is a question with money behind it, and we do not know the answer.10

  4. At Al Marjan: everything in writing, and from a local lawyer

    Confirmation of the plot's status, of the nature of the right you are acquiring and of its duration; where the transaction is registered and when; and what protections apply to your money until handover – because Dubai's escrow arrangements do not apply there under that law.13

What this page is not saying

  • It does not say one area is better than another. It says they are checked differently.
  • It does not describe Ras Al Khaimah's property law, because we could not verify it against an official text.
  • It asserts nothing about any specific project's gaming licences, and rests on none.
  • It contains no forecast of prices, yield or occupancy for any area.
  • It confirms no particular plot's status. That is done with the Land Department alone.
  • The information is accurate as at the review date at the top of the page.

Common questions

Do Dubai's protections apply at Al Marjan Island too?
Not under the same law. Al Marjan is in Ras Al Khaimah, which has its own land register administered by the Lands & Properties Sector of RAK Municipality, and its own rules. The escrow accounts law, the interim register and Article 11 are Dubai legislation. What does protect the money there is a question for a local lawyer – we do not set out the emirate's rules because we could not verify them against an official text.
How do I know a particular Dubai area is open to foreign ownership?
